1.1 Mojo Network, Mojo, Platform, we, us, our refers to the digital services, websites, mobile applications, APIs, tools, content management systems and community portals operated by MoJo India Network, incorporated under the Companies Act, 2013 in India.
1.2 User, you, your means any individual or legal entity that registers for, accesses, or uses the Platform.
1.3 Content means any data, information, text, graphics, audio, video, or other materials posted, uploaded, or transmitted on the Platform.
1.4 User Content means Content submitted by Users, including posts, comments, advertisements, multimedia, and feedback.
1.5 IT Act, IT Rules,PRGI Guidelines refer respectively to the Information Technology Act, 2000 and its rules , and the Press Council of India guidelines.
2.1 These Terms, along with the Privacy Policy, Cookies Policy, and Community Guidelines (together, “Policies”), constitute the entire agreement between you and Mojo and govern your access to and use of the Platform.
2.2 By registering for or using the Platform, you expressly agree to comply with these Terms and all applicable Indian laws including the IT Act, IPC, Digital Personal Data Protection Act, 2023, and constitutional provisions.
2.3 If you disagree with any part of these Terms, you must immediately discontinue use of the Platform.
3.1 Age & Capacity: You must be at least 18 years old and legally capable of entering into contracts under the Indian Contract Act, 1872.
3.2 Registration: To access certain features, you must register using accurate personal information (name, email, phone). You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
3.3 KYC & Compliance: Mojo may require KYC or other regulatory verification in accordance with RBI or other authorities.
4.1 Lawful Use: Use the Platform only for lawful, ethical purposes.
4.2 Prohibited Content: You must not post or transmit Content that is unlawful, defamatory, obscene, hateful, incites violence, infringes IP rights, contains malware, or constitutes spam, phishing, or data scraping.
4.3 Advertisements & Promotions: Any ads you post must comply with these Terms and applicable laws. You alone are responsible for User-served ads; Mojo disclaims liability for any loss or claims arising from them.
4.4 Reporting Violations: You must promptly report any Terms violations, security breaches, or misuse via the Grievance Redressal Officer.
5.1 Content Moderation: Mojo may review, modify, reject, or remove any User Content or advertisements at its sole discretion without notice or liability.
5.2 Platform Notices: Mojo may post system updates, notices, or promotional materials on your dashboard without prior approval.
5.3 License Grant: By submitting User Content, you grant Mojo a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to host, reproduce, distribute, display, adapt, and promote such Content, including for marketing and promotional use.
5.4 Data Usage: You consent to Mojo’s use of personal and aggregated data (usage metrics, analytics, Content metadata) for improving services, research, and marketing, subject to the Privacy Policy.
6.1 Data Collection: We collect Personal Data (name, contact, KYC), Usage Data (IP address, device ID, cookies), and Content metadata.
6.2 Purpose: Data is processed for service delivery, security, analytics, compliance, and promotional activities.
6.3 Third-Party Sharing: We may share data with payment gateways, cloud/hosting providers, analytics vendors, and legal authorities as required by law.
6.4 Cookies & Tracking: Detailed in our Cookies Policy; we use essential, analytics, preference, and advertising cookies.
6.5 Retention & Security: Data is retained per legal and business requirements and deleted on request, subject to obligations. We implement encryption, access controls, and audits to secure data.
7.1 Purpose: Foster respectful, constructive interaction.
7.2 Respect & Civility: No harassment, hate speech, or personal attacks.
7.3 Content Standards: No false claims, violence, adult content, extremist or defamatory material; cite sources for factual statements.
7.4 Enforcement: Violations may lead to content removal, account suspension, or ban.
8.1 Mojo IP: All trademarks, logos, software, and proprietary Content on the Platform are owned by or licensed to Mojo. Unauthorized use is prohibited.
8.2 User IP: You warrant that you own or have rights to all User Content and indemnify Mojo against any infringement claims.
9.1 "As-Is" Service: The Platform is provided "as-is" and "as-available", without warranties of any kind.
9.2 Intermediary Safe Harbor: Mojo is an intermediary under Section 2(1)(w) and Section 79 of the IT Act, subject to compliance with due diligence and takedown obligations.
9.3 Liability Cap: Mojo’s aggregate liability shall not exceed ₹1,000 or the total fees paid by you in the preceding 12 months, whichever is lower. We shall not be liable for indirect, incidental, punitive, or consequential damages.
You agree to indemnify, defend, and hold harmless Mojo, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your breach of these Terms or your use of the Platform.
11.1 Mojo may modify these Terms at any time; changes are effective upon posting. Continued use implies acceptance.
11.2 We may suspend or terminate your access for violations, legal compliance, or operational reasons without notice. Termination does not waive our rights to pursue remedies.
These Terms are governed by Indian law. Disputes shall be subject to the exclusive jurisdiction of courts in Bhopal, India.
